FIRST IN PI — GUIDEPOST POACHES POERSCH: Veteran Democratic lobbyist Jennifer Poersch has left Hannegan, Landau, Poersch & Rosenbaum Advocacy, the firm she helped launch a dozen years ago, to join GuidePost Strategies as an equity partner.

— GuidePost was launched in 2016 by GOP strategist Phil Cox — a former adviser to Florida Gov. Ron DeSantis — and fellow Republican Governors Association alum Marie Sanderson. The firm is part of the consulting conglomerate GP3 Partners and has added a couple of Democratic lobbyists in recent years, but Poersch is the firm’s most high-profile bipartisan addition.

— Poersch has already brought several big-name clients over with her to GuidePost, according to disclosure filings, including Walmart, Comcast, General Dynamics, Charter Communications, NCTA and Cruise.

WHAT THE NUMBERS MEAN: Business at D.C.’s top lobbying firms remained steady last quarter, with several shops posting record Q1 lobbying revenues as Congress worked to pass spending bills and clients began jockeying to position themselves for next year’s tax lobbying bonanza and various possible election outcomes.

— “People are now … really gearing up towards tax reform,” Akin Gump’s Brian Pomper told PI of the activity around the 2025 expiration date for a number of prized tax breaks from the 2017 GOP tax bill, though “that’s been kind of a steady slow burn for quite some time as people try to position and jockey for that,” he added.

— The firm brought in $13.8 million in lobbying fees last quarter, down slightly from the last quarter of 2023 but still good enough to set a Q1 record for the firm. Akin Gump received $240,000 for its lobbying work on behalf of Japan’s Nippon Steel and its proposed acquisition of U.S. Steel, in addition to $200,000 from the Southeastern Conference, $120,000 from retailer Shein and $80,000 from ChatGPT-owner OpenAI.

— Artificial intelligence continued to be a “pervasive” issue across clients last quarter, Pomper added, and it doesn’t appear to be fading anytime soon. Pomper said that in addition to raising concerns about taxes, clients are also beginning to ask about an upcoming deadline for potential renegotiations to the U.S.-Mexico Canada trade agreement.

— Clients are also looking ahead toward the post-election season, whether that means gaming out what’s in store regardless of who wins the White House, House or Senate in November, or determining what could move in the lame duck, said Nadeam Elshami, a policy director at Brownstein. “Both current and new clients are saying, ‘Alright, let’s scenario-plan for next year … the day after the election, when it’s all Democratic or Republican or divided government, what is that going to mean for us?’” he told PI.

Stewart Verdery of Monument Advocacy said in a statement that his firm is “working overtime” to help clients plan for the election, while Pomper noted that client executives “are calling to say, ‘Hey, I need a plan, no matter what happens this fall.’”

— Some on K Street saw their work move away from traditional advocacy last quarter because of razor-thin majorities in each chamber of Congress. “With the Hill gridlocked on so many issues early in 2024, we saw a meaningful shift in resources to public affairs campaigns to get clients’ issues prioritized,” said Verdery.

— Verdery, whose firm’s lobbying revenues dipped slightly to $3.6 million last quarter, compared to $3.8 million in Q4 and $3.9 million in Q1 2023, said Monument’s work last quarter included the spy powers bill, appropriations and the farm bill.

— As for what’s in store during the lame duck session of Congress afterward, “we’re not really going to have an answer until post-election,” Elshami said, pointing to AI and health care measures as possibilities.

TIKTOK LOBBYING JUMPS AGAIN: TikTok and its parent company ByteDance poured nearly $2.7 million into lobbying last quarter as the video platform fought for its life in Washington. ByteDance’s lobbying expenditures in Q1 were almost double what it spent in the final three months of 2023, and were its second-highest ever — though the company said its all-time record of $3.8 million spent in the third quarter of 2023 was largely due to “a unique settlement of Restricted Stock Units that are part of our employee compensation.”

— The platform’s in-house and contract lobbyists reported contacting the House, Senate, Executive Office of the President, Commerce Department and FCC as it sought to fend off fast-moving legislation to force the sale of TikTok or result in the app being banned. The Senate could send the measure to President Joe Biden’s desk as soon as tonight as part of the larger Ukraine-Israel-Taiwan foreign aid package.

ABOUT META’S SPENDING SURGE: At the same time the Hill was scrambling to pass its TikTok bill, industry foe Meta reported shattering its previous quarterly record for lobbying outlays. Meta, which owns rival social media giants Instagram and Facebook, reported $7.6 million in lobbying expenses last quarter. That was more than any other individual company, and marked a nearly $3 million increase over what it spent the previous quarter.

— Meta didn’t report lobbying on the TikTok legislation, and attributed the increase “principally to operating expenses, including changes to the timing of the biannual compensation structure and an elevated stock price,” Meta spokesperson Daniel Roberts told PI, rather than the result of a surge in advocacy efforts.

BECERRA’S PLANS: “Health and Human Services Secretary Xavier Becerra’s plans to leave the Biden administration and run for California governor are more advanced than previously known — with hiring discussions and spending further developed than he’s letting on,” Daniel and Chris Cadelago report.

— “Not only has Becerra had conversations over the past weeks about making the move, he or emissaries have approached political firms about standing up a gubernatorial campaign to succeed Gov. Gavin Newsom in 2026, two people briefed on those discussions told POLITICO.”

— “Becerra, a former longtime member of Congress from Los Angeles and California attorney general, also has spent more than $130,000 over the last year for ‘campaign consultants,’ activity that has not previously been reported in the media. The political outreach and payments have occurred even as Becerra has continued to state publicly that he’s solely focused on his Cabinet job in Washington.”

At the end of Fiscal Year 2023, FAA netted an additional 15 Certified Professional Controllers and only 15 new trainees compared to the end of FY22.

In May 2023, Secretary Buttigieg said, “The FAA is about 3,000 air traffic controllers short of target levels.”

Last November, the FAA’s independent National Airspace System Safety Review Team concluded that under FAA’s most recent CWP submitted to Congress, “when retirements and other attrition is accounted for, the hiring plan produces a negligible improvement over today’s understaffed levels, resulting in a net increase of fewer than 200 air traffic controllers by 2032.”

The DOT IG last summer issued a report that concluded “FAA continues to face staffing challenges and lacks a plan to address them, which in turn poses a risk to the continuity of air traffic operations.”

Congress has a historic opportunity to fix these problems in FAA Reauthorization. Now is that time. Learn more.
