WHAT THE NUMBERS MEAN: Some of D.C.’s top government relations shops saw lobbying revenues dip last quarter — not an unusual occurrence before an election, as lawmakers are on the campaign trail rather than taking votes.

— But other firms posted record revenues, and many of K Street’s lobbying giants were still busier than the same time last year as lobbyists prepare for a post-election sprint and look ahead to next year’s tax fight.

Akin Gump Strauss Hauer & Feld pulled in $14.4 million in the third quarter, an all-time high for the firm and an almost 5 percent increase from Q2. The firm — which brought in $1.3 million from Japan’s Nippon Steel to lobby for its proposed merger with U.S. Steel — was “especially busy in the areas of trade, health care, AI, and tax,” partner Brian Pomper said in a statement.

— Akin also made a major hire in anticipation of the tax cliff: the 2017 tax bill’s chief architect, former Ways and Means Chair Kevin Brady, who Pomper said has already begun advising clients. Brady has not, however, registered to lobby.

— Despite a slight dip, Brownstein Hyatt Farber Schreck held on to the top spot in the revenue rankings, and the firm’s $17 million in lobbying revenues were still nearly 13 percent higher than the third quarter of 2023.

Holland & Knight also saw quarter-over-quarter revenues drop by 4 percent, to $12.5 million last quarter, while Ballard Partners and Strategic Marketing Innovations both posted quarterly increases of more than 9 percent, to $4.8 million and $4.6 million, respectively.

— “Tax is taking up a lot of our team's time,” said Nadeam Elshami, who co-leads Brownstein’s lobbying practice. K Street is also spending a considerable amount of time teeing clients up for having their priorities included in any number of potential lame-duck bills, though a ton still depends on how the elections shake out.

— “It is all about preparation and planning right now,” said Karishma Page, a partner at K&L Gates. The firm’s revenues dropped by around 10 percent last quarter, but “there are going to be so many issues before us with a new White House, with new majorities in the House and Senate, that that it is going to be really critical for stakeholders to be strategic, to be prepared to really continue broad-based engagement,” she added.

— “If you wait until the last second and not plan on these scenarios, and all of a sudden there's an opportunity to move items on a big bill … then you've done a disservice,” Elshami agreed.

FIRST IN PI — ELIAS-LINKED ‘NEWS’ SITE HIT WITH CAMPAIGN FINANCE COMPLAINTS: The conservative watchdog group Americans for Public Trust today filed complaints against Star Spangled Media LLC, alleging that the entity is operating a news website that is violating campaign finance laws by regurgitating Democratic talking points, Daniel reports.

— In letters to Wisconsin, Pennsylvania and Michigan officials, Americans for Public Trust said that the company appears to violate various provisions of those states’ laws since it hasn’t registered as a political committee and reported its contributions and disbursements. It also said that the republication of campaign materials means that Star Spangled Media’s activities aren’t “independent” from campaigns it writes about positively, disqualifying it as “independent expenditures” under the three states’ laws.

— “Their ‘articles’ simultaneously criticize the legislative records of incumbent Republicans while highlighting Democratic candidates, and is then followed by SSM’s spending on social media digital advertising, promoting the same Democratic politicians,” APT executive director Caitlin Sutherland wrote in the letters.

— The letters include numerous examples of Star Spangled Media’s Facebook ad spending that supports specific Democratic candidates for state legislature seats that are priority races for the Democratic Legislative Campaign Committee. APT says that Star Spangled Media has spent up to $154,000 on advertising in Michigan, up to $129,000 in Pennsylvania and up to $98,000 in Wisconsin.

— On its website’s two-sentence “About Us” page, Star Spangled Media’s The Morning Mirror says that it’s a website “where reliability meets fresh insight.” But in its three letters, APT describes how Star Spangled Media isn’t doing actual journalism and instead is just copy and pasting Democratic talking points.

— For instance, Michigan state Rep. Jenn Hill lists on her campaign website that passing the Reproductive Health Act was one of her “proudest accomplishments.” The Morning Mirror then put out an article with the headline “Rep. Jenn Hill Says One of Her ‘Proudest Accomplishments’ is Supporting Reproductive Rights.” It also ran a paid ad campaign on Facebook highlighting Hill’s “proudest accomplishments” on reproductive rights in Michigan.

— The letters also quote from the State of Arizona’s Citizens Clean Elections Commission, which noted that “[u]nlike many news sites, including left and right of center websites, The Morning Mirror includes no masthead, no bylines, no staff information, no contact information, no information about purchasing advertising or making donations, and no mailing or physical address.”

— It’s unclear who funds the site but Semafor previously reported that the site is represented by Elias Law Group, the political law firm headed by Marc Elias, who is also helping out Kamala Harris’ presidential campaign.

— In his capacity as counsel to Star Spangled Media, Elias Law Group partner Jonathan Berkon said in a statement to PI: “Americans for Public Trust has a history of filing frivolous complaints in the past that have been dismissed. This complaint will be no exception.”

ANNALS OF ONLINE FUNDRAISING: CNN’s Blake Ellis, Melanie Hicken, Yahya Abou-Ghazala, Audrey Ash, Kyung Lah, Anna-Maja Rappard, Casey Tolan, Lou Robinson and Byron Manley, have a sobering piece out today uncovering “how deceptive political fundraisers have victimized hundreds of elderly Americans and misled those battling dementia or other cognitive impairments into giving away millions of dollars — far more than they ever intended.”

— The CNN crew zooms in on more than 50 of the largest of those donors, some of whom “unintentionally joined the ranks of the top grassroots political donors in the country as they tapped into retirement savings and went into debt, contributing six-figure sums through thousands of transactions.”

GET TO KNOW THE CRYPTO FRESHMEN: “As many as 13 new pro-crypto candidates could ascend to seats in the House next year with backing from the industry’s network of super PACs, which have spent big to promote allies and block critics in races across the country,” our Jasper Goodman writes.

— “The potential House members range from progressive Democrats who tout digital assets as a tool for financial inclusion to Republicans who bash the Biden administration’s crypto policy and say the technology can create ‘economic freedom.’”

— Thanks to the industry’s $160 million gusher of political spending, “regardless of who wins the presidency, the result of the 2024 elections is likely to be the most pro-crypto Congress ever — and one that could deliver the industry’s long-held lobbying priority of removing regulatory roadblocks.”
